Welcome to DebateRoom ("DebateRoom," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the website located at https://www.debate-room.com (the "Site") and any services, features, or content provided through it (the "Service").

By accessing or using the Site or Service, you agree to be bound by these Terms. If you do not agree, do not access or use DebateRoom.

1. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to access or use DebateRoom. By using the Service, you represent and warrant that you meet these requirements and are not prohibited from using the Service under any applicable laws.

2. Nature of the Service

DebateRoom is a web-based platform that facilitates live, one-on-one video or audio debates between users based on selected topics and opposing viewpoints.

DebateRoom does not:

  • Create, endorse, or verify user content
  • Guarantee the accuracy, quality, or conduct of any participant
  • Provide professional, legal, medical, or political advice
  • Moderate debates in real time

All debates, statements, and opinions are user-generated and reflect the views of the participants alone.

3. No Recording by DebateRoom

DebateRoom does not record, store, monitor, or review audio or video communications that occur during debates.

Live communications occur directly between participants using real-time communication technologies (such as WebRTC). DebateRoom does not control and cannot prevent participants from recording debates using their own devices or software.

You are solely responsible for complying with all applicable laws regarding recording, consent, and data use.

4. Assumption of Risk

By using DebateRoom, you acknowledge and agree that:

  • You may encounter opinions, language, or viewpoints that are offensive, upsetting, or objectionable
  • Debates may involve disagreement, confrontation, or strong rhetoric
  • Interactions with other users are inherently unpredictable

You voluntarily assume all risks associated with participating in live debates and interacting with other users.

5. User Conduct

You agree not to use DebateRoom to:

  • Harass, threaten, intimidate, or abuse others
  • Engage in hate speech, violence, or illegal activity
  • Share sexually explicit or exploitative content
  • Impersonate others or misrepresent your identity
  • Disrupt, exploit, scrape, reverse engineer, or misuse the Service
  • Circumvent security, access controls, or usage limits

This list is non-exhaustive.

6. Enforcement and Termination

DebateRoom reserves the right, at its sole discretion and without notice, to:

  • Restrict, suspend, or terminate access to the Service
  • Block users, IP addresses, devices, or regions
  • Remove or restrict content
  • Take any action deemed necessary to protect users, the platform, or legal compliance

Enforcement may occur through automated systems, user reports, post-interaction review, or other methods. DebateRoom does not guarantee real-time enforcement.

All enforcement decisions are final.

7. User Submissions and Feedback

If you submit feedback, suggestions, reports, or other content to DebateRoom, you grant DebateRoom a non-exclusive, worldwide, royalty-free, perpetual license to use such content for operating, improving, and promoting the Service.

Submissions are voluntary and non-confidential.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

DebateRoom disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, DebateRoom shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the Service or interactions with other users.

10. Indemnification

You agree to indemnify, defend, and hold harmless DebateRoom and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including attorneys' fees) arising from:

  • Your use of the Service
  • Your participation in debates
  • Your violation of these Terms
  • Your violation of any applicable law or third-party rights

11. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located within the State of New Jersey, and you consent to personal jurisdiction in such courts.

12. Arbitration and Class Action Waiver

At DebateRoom's sole discretion, disputes may be resolved through binding individual arbitration rather than in court.

You agree that any claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative action.

13. Changes to These Terms

DebateRoom may update these Terms at any time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
